Luxe Pass (“Luxe Pass”) is a subscription membership program offered by MiniLuxe, Inc. (“MiniLuxe”) to certain of its customers. These terms and conditions form the agreement between each customer that purchases a membership in Luxe Pass (each, a “Member”) and MiniLuxe with respect to Luxe Pass and such Member’s membership and participation in Luxe Pass. MiniLuxe reserves the right to change these terms and conditions, and to adopt additional rules, regulations, policies, or procedures related to Luxe Pass (collectively, the “Policies”), and/or MiniLuxe’s other offers, products and services, at any time, for any reason, and with or without prior written notice to the Members. By becoming a Member and participating in Luxe Pass, you hereby agree to these terms and conditions as they are in effect from time to time, as posted at each MiniLuxe studio location or on the Web at http://www.miniluxe.com or as they are otherwise provided to you (the “Luxe Pass Terms”). Each Member agrees to and represents that the Member is fully able and competent to enter into, abide by and comply with the Luxe Pass Terms and the Policies.
Subject to the Luxe Pass Terms, each Member is entitled to receive, at any participating MiniLuxe location:
* Subject to appointment availability and MiniLuxe’s right to limit each Member to one Signature Manicure during any 24 hour period. At any appointment, a Member may choose to receive under Luxe Pass a Naked Manicure or a Color Refresh instead of a Signature Manicure for no additional payment.
A Member may elect to receive a Performance Polish Manicure or Gel Polish Manicure, instead of an Unlimited Signature Manicure, under Luxe Pass. If the Member receives a Performance Polish Manicure or Gel Polish Manicure at a participating MiniLuxe location under Luxe Pass, the Member will be required to pay, at the time of service, the difference in the location’s retail price of the Performance Polish Manicure or Gel Polish Manicure, as applicable, over the location’s retail price of the Signature Manicure.
If a Member receives a manicure under Luxe Pass and a pedicure in a single appointment at a participating Miniluxe location, the Member will receive a $5.00 discount off of the location’s retail price of the pedicure.
Except as provided in the Luxe Pass Terms, Members may not receive, or combine with any Luxe Pass discounts or services, any other discounts on MiniLuxe’s products or services.
Luxe Pass benefits may be received only at participating MiniLuxe locations. A list of MiniLuxe locations participating in Luxe Pass is posted on the Web at http://www.miniluxe.com.
Each Member agrees to pay the applicable Luxe Pass monthly fee described in the Luxe Pass Terms (the “Monthly Fee”). The Monthly Fee, which will vary by state, will be posted by MiniLuxe at participating MiniLuxe locations and on the Web at http://www.miniluxe.com. The Monthly Fee applicable to each Member will be the Monthly Fee in effect for the state in which the Member resides or, if there is no MiniLuxe location in the Member’s state of residence, the nearest state (as determined by MiniLuxe in its discretion) that has a MiniLuxe participating location.
THE MEMBER ACKNOWLEDGES THAT THE MONTHLY FEES WILL RECUR MONTHLY UNTIL THE MEMBER’S MEMBERSHIP IN LUXE PASS IS TERMINATED BY THE MEMBER OR BY MINILUXE, AS PROVIDED UNDER THE HEADING “TERMINATION” BELOW.
FOR THE MONTH IN WHICH A MEMBER ACCEPTS THESE TERMS AND CONDITIONS (THE “FIRST MONTH”), THE MONTHLY FEE WILL BE CHARGED TO THE MEMBER’S CREDIT CARD ON THE DATE OF THIS ACCEPTANCE (THE “ACCEPTANCE DATE”). THIS MONTHLY FEE WILL COVER THE MEMBER’S PARTICIPATION IN LUXE PASS FOR THE REMAINDER OF THE FIRST MONTH, AND WILL BE PRORATED FOR THE NUMBER OF DAYS REMAINING IN THE FIRST MONTH AFTER THE ACCEPTANCE DATE.
FOR EACH MONTH AFTER THE FIRST MONTH, THE MONTHLY FEE FOR SUCH MONTH FEE WILL BE CHARGED AUTOMATICALLY TO THE MEMBER’S CREDIT CARD ON OR AROUND THE LAST BUSINESS DAY OF THE PRIOR CALENDAR MONTH.
The Monthly Fees do not include gratuities.
A MEMBER MAY TERMINATE HIS OR HER MEMBERSHIP IN LUXE PASS AT ANY TIME, WITHOUT PENALTY, BY SENDING AN EMAIL STATING THE MEMBER’S NAME TO VIP@MINILUXE.COM.
IF A MEMBER CHOOSES TO REACTIVATE THEIR ACCOUNT AFTER CANCELLATION, THEY MUST WAIT UNTIL 3 MONTHS HAVE ELAPSED BEFORE ACTIVATING. A REACTIVATION FEE MAY APPLY IF THE ACCOUNT HAS BEEN CANCELLED MORE THAN ONCE.
IN ADDITION, MINILUXE MAY TERMINATE A MEMBER’S MEMBERSHIP IN LUXE PASS, OR THE LUXE PASS PROGRAM, AT ANY TIME AND FOR ANY REASON.
UPON TERMINATION OF A MEMBER’S MEMBERSHIP IN LUXE PASS, MINILUXE WILL IMMEDIATELY CEASE CHARGING THE MEMBER FOR MONTHLY FEES AND, EXCEPT AS OTHERWISE STATED BELOW, THE MEMBER WILL CONTINUE TO RECEIVE THE LUXE PASS BENEFITS UNTIL THE END OF THE LAST MONTH FOR WHICH THE MEMBER HAS, PRIOR TO SUCH TERMINATION, PAID A MONTHLY FEE (“TAIL BENEFITS”) AND MINILUXE WILL NOT REFUND ANY PORTION OF ANY PREVIOUSLY CHARGED MONTHLY FEES.
IF MINILUXE TERMINATES A MEMBER’S MEMBERSHIP IN LUXE PASS WITHOUT ENTITLING THE MEMBER TO RECEIVE ANY OR ALL OF SUCH MEMBER’S TAIL BENEFITS, THEN MINILUXE WILL, EXCEPT IN THE LIMITED CIRCUMSTANCES DESCRIBED UNDER THE HEADING “USE AND NON-TRANSFERABILITY OF BENEFITS” BELOW, REFUND TO THE MEMBER THE CORRESPONDING PORTION OF ANY MONTHLY FEES PAID BY SUCH MEMBER PRIOR TO SUCH TERMINATION.
No Member may receive any Luxe Pass benefits unless and until the Member has accepted the Luxe Pass Terms whether at a MiniLuxe location, over the Web, or as otherwise provided for by MiniLuxe.
A Member must provide his or her name and identify himself or herself as a Luxe Pass Member in order to receive Luxe Pass benefits, including when making any appointment for services under Luxe Pass.
MiniLuxe may at any time, including prior to providing any service or product discount to a Member under Luxe Pass, require the Member to confirm the Member’s up-to-date address, other contact, and credit card billing information, including by providing an appropriate government-issued identification.
Membership in Luxe Pass and any benefits of being a Member, including Signature Manicures, Naked Manicures, Color Refreshes and product discounts, are non-transferrable and can only be used by the Member.
ANY REFUSAL BY A MEMBER TO PROVIDE HIS OR HER IDENTITY OR ANY REQUIRED IDENTIFICATION, OR OTHERWISE TO CONFIRM SUCH MEMBER’S INFORMATION APPLICABLE TO LUXE PASS, OR ANY ATTEMPT BY A MEMBER TO TRANSFER ANY LUXE PASS BENEFIT, WILL BE GROUNDS FOR MINILUXE TO DENY LUXE PASS BENEFITS TO SUCH MEMBER, OR TO TERMINATE IMMEDIATELY THE MEMBER’S MEMBERSHIP IN LUXE PASS WITHOUT ANY REFUND.
Each Member consents to the receipt of communication from MiniLuxe via e-mail, phone, text message, external websites and any other method of communication MiniLuxe deems appropriate. MiniLuxe and its marketing partners may use these channels to communicate with Members regarding requested products or services, Luxe Pass account status, changes to the Luxe Pass program, the Luxe Pass Terms or the Policies, and other matters MiniLuxe believes may be of interest to Members.
Each Member agrees to keep MiniLuxe (or its designated third-party payment provider) informed of the Member’s up-to-date identity, address, other contact, and credit card billing information.
MiniLuxe may, at any time and without terminating Luxe Pass, determine that no additional memberships in Luxe Passes will be offered or sold.
Each Member must be at least 18 years of age or, if a Member is under 18 years of age, a parent or legal guardian must also accept the Lux Pass Terms and provide such parent or guardian’s credit card billing information for payment of the Monthly Fee.

The Member (and, if such Member is less than 18 years of age, a parent or legal guardian of the Member) hereby accepts, and agrees to be bound by, the Luxe Pass Terms and the Policies, as they are in effect from time to time.
